On 23 April 2026, the Federal Court of Australia handed down judgment in ASIC v Nuix Limited & Ors [2026] FCA 490.
Following a lengthy trial in 2023, Justice Goodman found that ASIC had failed to make out any part of its continuous disclosure and director’s duties case. Both Nuix and the directors were wholly successful in their defence of this civil penalty proceeding.
